  1. Introduction

    These General Terms and Conditions (hereinafter referred to as the "GTC") apply to all legal transactions concluded for repair services via our website www.recommerce.ch or directly on site. The website is operated by Recommerce AG (hereinafter referred to as "Recommerce").

    Our services are intended exclusively for private individuals or business customers (hereinafter referred to as the "Customer") who are domiciled or have their registered office in Switzerland or Liechtenstein. Deliveries are made exclusively to addresses in Switzerland or Liechtenstein.

    The prices shown on the websites are indicative prices only. A binding offer is made only when a cost estimate is sent following inspection of the device. By approving the cost estimate, the Customer accepts the GTC valid at that time.
  2. Cost Estimate and Repair

    A cost estimate is issued if a warranty claim is rejected or for a chargeable repair.

    If the Customer accepts the cost estimate, the Customer undertakes to pay the amount within 10 days. The repair will be carried out after payment has been received.

    If the Customer rejects the cost estimate or cancels the order after we have already received the device, a processing fee of CHF 39.00 including VAT will be charged.

    If the Customer does not respond within 30 days after the cost estimate has been sent, Recommerce will return the device and will also charge the Customer this processing fee.

    If the Customer waives the return of the device, ownership of the device will pass to Recommerce. If the data cannot be completely erased, the device will be sent to Immark AG for shredding.
  3. Submission and Shipping

    The device is sent to us and returned using Swiss Post PostPac Priority (normally delivered on the next working day), provided that the Customer uses our postage label.

    The device is shipped using the “Registered Mail” delivery option so that it is adequately insured in the event of transport damage (liability limit: CHF 1,500.00).

    The General Terms and conditions of Swiss Post apply to transportation.

  4. Refusal of Acceptance

    If a Customer refuses to accept the returned shipment, the device will be returned to Recommerce and stored for 60 days. If the Customer does not contact Recommerce during this period, ownership will pass to Recommerce, which may dispose of the device at its own discretion.
  5. Warranty and Liability

    The warranty period for repairs is 3 months and is specified on the invoice or the Recommerce warranty certificate. It begins on the date of delivery or collection.

    During this period, Recommerce warrants that the repaired spare part is free from defects and functions properly. Any warranty for the other components of the repaired device is excluded.

    If Recommerce provides a service under warranty, Recommerce grants a warranty of 3 months on the repaired or replaced device; if the original warranty period is longer, the original period will apply. These warranty periods are neither suspended nor restarted by any warranty service.

    After the repair, the defective spare part becomes the property of Recommerce.
  6. Data Backup

    It is possible that all data stored on the device may be erased during a repair. Recommerce excludes all liability for such data loss.

    For this reason, the Customer is obliged to back up personal data before submitting the products. Restoring the data is the Customer’s responsibility.
  7. Exclusion of Liability

    Liability is governed by the applicable statutory provisions. To the extent permitted by law, Recommerce excludes all liability for losses or damage of any kind.
  8. Data Protection

    The Privacy Policy applies to the processing of personal data by Recommerce.
  9. Jurisdiction

    All legal relationships between Recommerce and the Customer are governed by Swiss law. The place of jurisdiction is Zug.
